1-5-702. Definitions. As used in this part 7, unless the context otherwise requires: (1) Accessible voter interface device means a device that communicates voting instructions and the information on the ballot to an elector and allows the elector to select and vote for candidates, ballot questions, and ballot issues in accordance with the standards in section 1-5-704. A ballot marking device may be considered an accessible voter interface device. (2) Alternative formats has the same meaning ascribed in the federal Americans with Disabilities Act of 1990, as amended, (Pub.L. 101-336), codified at 42 U.S.C. sec. 12101 et seq., including specifically the technical assistance manuals promulgated thereunder. (2.5) Ballot marking device means a device that allows an elector to mark a ballot card used in an electromechanical voting system and that meets the standards in section 1-5-704 (1)(o). (2.7) [Editor's note: For the applicability of this subsection (2.7) on or after January 1, 2026, see the editor's note following this section.] Covered entity means: (a) An adult day care facility, as defined in section 25.5-6-303 (1); (b) An alternative care facility, as defined in section 25.5-6-303 (3); (c) An assisted living residence, as defined in section 25-27-102 (1.3); (d) A community residential home, as defined in section 25.5-10-202 (5); (e) An intermediate nursing facility for persons with intellectual and developmental disabilities, as defined in section 25.5-4-103 (9); (f) A nursing facility, as defined in section 25.5-4-103 (14); or (g) A state-run psychiatric hospital or mental health institute operated by the department of human services created in section 26-1-105. (3) Tactile input device means a device such as a keyboard with which an elector provides information to a voting system by touching the device.
